Starting Out

Perhaps the most confusing, frustrating, overwhelming and frightening event a married person can experience is a divorce. While there is no part of a divorce that could ever be characterized or thought of as pleasant, perhaps the most difficult is the beginning.

Even if you are the spouse who initiates the divorce the entire process can be monumental, say nothing if you are the spouse who ends up defending a divorce. However, regardless of the position you may find yourself in at the beginning of a divorce, with a little planning and organization you can greatly minimize difficulties you may otherwise experience while going through a divorce.

Remember, in the process of divorce, there is nothing worse than to ignore the process that you can do. Rest assured, if you ignore reality when your spouse begins divorce proceedings against you, you will have to live with a less than pleasant result.

However, having done your research into the subject of divorce, you will have the tools to know the basic steps to take to approach your divorce in an educated fashion.

If you initiate the divorce there is much you will want to do to be prepared as you start the process. If you are the spouse responding to a divorce, there is much you can do to ensure that your position is fully developed and to guarantee that you have the full right to be heard in the process. Either position requires only that you take the process seriously and do your homework.

Regardless of whether you are initiating the divorce or responding to your spouse’s allegations, you will need to consult and likely retain an attorney. You will need to decide how to find an attorney. You will need to find out if your spouse will be seeing an attorney. Many people immediately respond to this by saying that they cannot afford an attorney. Do not take this position. If it means paying for an attorney with credit, borrowing money or finding an attorney who will accept a payment plan, do whatever it takes to retain counsel to assist you. If you are sick with a major problem, you would go to the doctor. Divorce requires a visit to an attorney.

Most of all, you will need to do your homework so you can be prepared to assist in your divorce to make sure that things not only go as well as they can for you, but also so you can begin the process of working towards an end to your domestic situation.
